Damage Waiver Information

Sunshine Boat Rentals (SBR) understands that accidents happen. The Limited Liability  Waiver (LLW) we offer is a way to help LIMIT your financial obligations to SBR if the rental boat is damaged. Without the LLW in place, the renter is responsible for all damages and lost equipment. But if you elect to purchase the LLW, the renter would only be required to pay a maximum of $1000, in accordance with the terms below. Cost is $40 per rental for Coverage.

• Damage to the rental boat sustained during the rental time, provided the renter is NOT in violation of ANY PART of the Rental Agreement.

• Damage caused by failure to observe and comply with navigational markers, NY State boating laws, or instructions given by SBR staff.
• Damage caused while driver is under the influence of alcohol or drugs.
• Damage caused by smoking products like cigars, cigarettes or pipes.
• Damage to other property or persons.

• The LLW is NOT insurance ! The LLW is a product that SBR offers to LIMIT financial responsibility in the event of damage or loss to a rental boat.
• An Accident Report completed by the NY DEC or local Sheriff's Dept is REQUIRED to substantiate any claim. No claims will be accepted without this documentation.

If you agree to purchase the LLW as posted here, SBR agrees to limit the renter's financial responsibility to a maximum of $1000. The cost and extent of damage or loss incurred is determined at SBR's sole discretion. The LLW does not limit SBR's ability to seek compensation from third parties for damage caused by others.
